II. BACKGROUND

1. The United States initiated an investigation of the SCDC pursuant to Title II of the Americans with Disabilities Act (ADA), 42 U.S.C. §§ 12131-12134, following receipt of a complaint alleging that the SCDC failed to ensure effective communication for the complainant and other inmates with hearing disabilities, and denied them participation in educational and vocational programs on the basis of their disability. The United States' investigation included document review and interviews with SCDC inmates, personnel, and administrators.
