This website is being developed by Evan Terry Associates to try to answer common questions about the proper use of “conventional industry tolerances” as defined by the 2010 ADA Standards. As new technical assistance is released by the U.S. Access Board (or the Department of Justice) on this subject and as questions are answered, we will update this page to reflect the new information. Q4.) Are conditions like door closers that require force in excess of the maximum allowed by the standards considered true tolerances or are they simply non-compliance with the maintenance requirements of 35.133 or 36.211?
A4.) In our opinion, the plain language of the term “Construction and Manufacturing Tolerances” does not include adjustable conditions that can meet the detailed requirements when properly maintained.
