GENERAL PROHIBITION AGAINST DISCRIMINATION {35.130}

“No qualified individual with a disability shall, on the basis of disability, be excluded from participation in or be denied the benefits of the services, programs, or activities of a public entity, or be subjected to discrimination by any public entity.”

  • Directly, or

  • Through contracts, licensing or other arrangements

    • Deny participation, aid, benefit or service

    • Equal to that afforded others

    • As effective as afforded others

  • Provide different or separate aids, benefits or services unless:
