Equivalent Facilitation

2012 TAS Reference: 103

In accordance with the 2012 TAS, Advisory 103, all determinations of equivalent facilitation are made by the Department in accordance with the variance procedures contained in Chapter 68, Texas Administrative Code.

A RAS has no authority to allow any means of equivalent facilitation in lieu of compliance with the requirements of the 2012 TAS in the same way that a RAS had no authority under the 1994 TAS to allow any means of equivalent facilitation unless approved by the Department in accordance with the requirements of RAS Bulletin 001.
